Judge upset by Obama's comments on health care law

(AP) ? A federal appeals court judge on Tuesday seemed to take offense to comments President Barack Obama made earlier this week in which he warned that if the Supreme Court overturned his signature health care overhaul it would amount to overreach by an "unelected" court.

The Supreme Court is set to issue a ruling later this year on whether to strike down some or all of the historic health care law.

During oral arguments in Houston in a separate challenge to another aspect of the federal health care law, U.S. 5th Circuit Court of Appeals Judge Jerry Smith said Obama's comments troubled a number of people who have read them as a challenge to the authority of federal courts.

"I'm referring to statements by the president in the past few days to the effect, I'm sure you've heard about them, that it is somehow inappropriate for what he termed unelected judges to strike acts of Congress that have enjoyed, he was referring of course to Obamacare, to what he termed a broad consensus and majorities in both houses of Congress," Smith told Dana Kaersvang, an attorney with the Justice Department in Washington, D.C.

On Monday, Obama issued a direct challenge to the Supreme Court, saying he didn't believe the high court would take the "unprecedented" step of overturning a law passed by a strong majority of Congress.

"I want to be sure that you are telling us that the Attorney General and the Department of Justice do recognize the authority of the federal courts through unelected judges to strike acts of Congress or portions thereof in appropriate cases," Smith said.

A somewhat surprised Kaersvang told Smith the Justice Department does recognize this power by the courts and made reference to a landmark 1803 case that formed the basis for judicial review.

However, Smith ordered Kaersvang to submit a letter to the appeals court by Thursday stating the position of U.S. Attorney General Eric Holder and the Justice Department on the concept of judicial review.

"The letter needs to be at least three pages, single spaced, no less and it needs to be specific. It needs to make specific reference to the president's statements," Smith said.

The case before the appeals court was brought in part by a spine and joint hospital in East Texas that is challenging the constitutionality of a portion of the health care law that restricts physician-owned hospitals from expanding or building new facilities.

The Justice Department did not immediately return a telephone call late Tuesday seeking comment.

White House officials had no comment on Smith's statements, instead referring to comments Obama made earlier Tuesday at the annual meeting of The Associated Press in Washington.

At the meeting, Obama said the Supreme Court "is the final say on our Constitution and our laws, and all of us have to respect it. ... I have enormous confidence that in looking at this law, not only is it constitutional, but that the Court is going to exercise its jurisprudence carefully because of the profound power that our Supreme Court has."

Tyga Associate Honey Cocaine Performed The Day After Getting Shot

'I'm cool,' Honey tells MTV News two weeks after Omaha show where concertgoers opened fire on Tyga's tour vans.

Honey Cocaine may be nursing just a minor bullet wound, but considering the events that took place March 19, Tyga's rap protégé is taking things surprisingly well.

"The day after I was like, 'You know what? It happened, there's nothing I can do about it but just be safer, be more aware and just live life,' " the pint-sized MC told MTV News on Monday night while on the set of Tyga's "I'm Gone" video shoot in Lynwood, California.

Honey, who hails from Toronto, Canada, was shot in the arm following Tyga's tour stop in Omaha, Nebraska. Police reports confirmed that she was treated at the hospital following the shoot-out, but still the rap rookie performed on the next tour date. "It happened, but I'm cool, I performed the next day, 'cause I was just like, 'F--- it,'" she said.

The confrontation began while Tyga was onstage getting set to perform his hit single "Rack City" when a group of concertgoers began to throw things on stage. Tyga, who was clearly upset, began to bait the rowdy crowd and things escalated. After the show, the assailants fired upon one of the Young Money rapper's tour vans, hitting two members of his entourage. Honey believes that all the drama began after Tyga denied a local group's request to open for him at the show. "I guess Tyga didn't want it," she said. "He's the boss, that's his show, so I guess he just didn't want it and they had gotten really angry and started doing really disrespectful things like throwing bottles on stage, and Tyga just retaliated and responded."

At the time of the shooting, Honey says she wasn't sure what was happening.

"I was clueless, all I was told was the venue had some angry people and you should just do what you gotta do, get out," she said. "That's what I did. I left and still got hit."

Hackensack Financial Planners - Find a Local Financial Planner in ...

Hackensack financial planners are a great resource for families, couples and individuals in NJ and the surrounding area and can offer a range of services. Planners in Hackensack can help residents reach long-term financial goals through budget management, wealth preservation, debt management, education planning and even tax services. Managing your finances on your own can be difficult if you aren't sure how to invest or simply don't have the time to research your options. A NJ personal finance planner can give you clear answers to your questions and put you on the right track to paying college tuition for your kids, building your nest egg, and even taking family vacations along the way. Working with a New Jersey personal finance advisor allows you to prioritize your goals and develop a strategy to make them happen.

Common Services Offered

One of the most important services that a Hackensack financial planner can offer is debt management. It can be easy to use credit cards in a number of situations, even if you don't need to. For this reason, debt is one of the most common issues that Hackensack residents face and can become one of the biggest factors in hindering your long-term success. Even people with high incomes and strong assets can become victims of debt, and many never seek the professional help they need to avoid taking on unneeded balances. Hackensack financial planners can offer easy-to-follow strategies for quickly paying off credit cards, student loans, car payments and other types of debt so you are free to invest in your children's college education and your own long-term dreams. When researching financial planners in Hackensack, look for advisors who offer online debt management calculators so you can track your progress along with your advisor.

Another common service that a Hackensack financial planner can offer is retirement planning. Before choosing a financial planner, take some time to outline your dream retirement, including your desired lifestyle, how much you hope to travel and what activities you plan to enjoy. Using financial planning calculators, your Hackensack financial planner can help you determine what percentage of your current income you will need to realize your dream retirement lifestyle. For example, if you currently spend time and money on a professional wardrobe and entertainment, you can probably eliminate these expenses from your new retirement budget. If you love going out to eat in Hackensack and buying nice clothes, however, you might need a budget that is close to what you currently earn.

Tax planning and insurance are two services that personal finance planners offer to an increasing number of Hackensack residents. If you have a spouse or a family, chances are you will need to consider some form of life insurance. Your Hacknesack financial planner can help you determine what kind of policy is best for you based on your age and dependents. Your advisor can also council on you on tax-related issues, including how to avoid paying more than you need to in federal and NJ income tax. Many planners even offer tax return preparation services. When researching Hackensack financial planners, be sure to investigate the full range of services offered to ensure that all areas you need assistance with are covered.

Choosing a Financial Advisor

When researching personal finance planners in the Hackensack area, there are a number of factors to consider. The most important is accreditation. Be sure to choose a planner who is accredited with the state of New Jersey as a Certified Financial Planner. Look for the CFP suffix after an advisor's name. This certification guarantees that an advisor has achieved a minimum level of education, passed an exam and subscribes to continuous education to keep up with trends in the industry. A CFP must also abide by ethics standards and pledge to put a client's interests first. These accountability factors make certification an important quality to seek in a Hackensack financial planner.

Another important factor to consider when researching New Jersey personal finance planners is the fee structure. A fee-based structure is generally considered preferable to a commission-based structure, where a planner has an incentive to sell particular products. If you have complex assets and cannot find a fee-based planner in the New Jersey area who can serve your needs, you can also find an advisor with an asset-based structure, in which case you pay based on a percentage of your assets.

Whether you need assistance with debt management, budget planning, wealth preservation or even tax assistance, a Hackensack financial planner can be an exceptional resource for ensuring that you reach your long-term goals. Hackensack financial planners can give you the resources you need to make smart, confident decisions regarding your finances. Researching advisors online is an excellent way to find a certified planner with the expertise and experience that you seek.

Vegan Diet Guy | Are You A Serious Coffee Drinker?

A recent article in the Washington Post discussing the effects of various foods on heart health identified the greatest health risk of coffee as weight gain from blended coffee beverages packed with empty calories from sugar and dairy fat.

Lately, it seems the creator and biggest purveyor of the beverages has been trying to rise above criticism they?re as guilty as McDonalds and other fast food chains for contributing to high rates of obesity and diet-related diseases.

Along with introducing oatmeal to its menu, Starbucks published guides to 20 Drinks Under 200 Calories? as well as ?Favorite Foods under 350 calories? on its website. ?Unfortunately, Starbucks plays down the healthiest beverages (full-leaf teas, brewed coffee and Caffe Americano) which all have under 10 calories. For example?if you?ve grown tired of Pikes Place Roast?did you know that you can order any of Starbucks many varieties of coffee beans prepared with a French-press?

Adding milk or cream and sugar to brewed coffee is so common among Starbucks? U.S. customers, the baristas ?leave room? in the cup by default.?No wonder hard-core coffee drinkers (those who know the difference between an?ibrik and a v60) don?t take the chain seriously, especially after it introduced the lightly-roasted Blonde coffee (now its most popular), further blurring the line with pedestrian coffee.

Of course, only Starbucks? pure coffees/teas and those made with soymilk?instead of dairy milk?are of any interest to those on a whole foods plant-based diet.?For the record, Starbucks custom-blended soymilk contains more calories and saturated fat than its skim milk. However, soymilk contains no cholesterol (vs 5g for non-fat milk) and does contain fiber, a beneficial nutrient found only found in plant-based foods.

The below data from the company?s U.S. website refers to tall-size (12 fl oz / 355 ml)?drinks:

Calories, Fat (g), Carb. (g), Fiber (g), Protein

NonFat Milk 140, 0, 20, 0, 14

SoyMilk ? 210, 6, 26, 2, 11

*2% Milk ? 200, 8, 19, 0, 13

Whole Milk? 240, 13, 19, 0, 13

*May vary?created by the barista in each store mixing whole milk and non-fat milk

Ironically, many omnivores substitute soymilk for dairy milk because they have heard it?s healthier, or for the taste and variation, while still topping their beverage with dairy whip cream. Even if you question whether soymilk is a healthier or safer choice than cow?s milk, I would still choose soymilk for the humane aspects alone.

Starbucks ?Delicious ?Drink? list contains 3 cold drinks and 5 hot drinks that are vegan-friendly.

Cold Drinks

Calories, Fat (g)

  • Shaken Tazo? Iced Passion? Tea (unsweetened) 0, 0
  • Shaken Tazo? Iced Black Tea Lemonade 100, 0
  • Iced Coffee (with classic syrup) 60, 0

Hot Drinks

  • Brewed Coffee 5, 0
  • Brewed Tazo? Tea 0, 0
  • Caff? Americano 10, 0
  • Steamed Apple Juice 170, 0
  • Soy Chai Tea Latte 170, 2

If you hold the whip cream, the soymilk-based mocha, coffee and espresso Frappuccino have 190, 170 and 150 calories respectively.

Below are some more vegan-friendly beverage offerings, in order of increasing calories:

  • Soy Cafe Misto (brewed coffee with steamed soy milk)?80 calories
  • ?Dry? (reduced steamed milk) Cappucino?below 90 calories
  • Full-Leaf Soy Tea Lattes?140 calories
  • Soy Latte?150 calories
  • Soy Caramel Macchiato?180 calories
  • Soy Caffe Mocha?200 calories (no whip)
  • Soy hot chocolate?200 calories (no whip)

To reduce calories further, ask the barista to reduce or eliminate syrups (20-25 calories per pump). For example, a tall drink generally? contains 3 pumps, so you may ask for 1 or 2 instead.?And if you omit any drizzled sauces on top, you?ll save about 15 calories, too.

In fact?except for that rare special occasion (your birthday, a lunar eclipse, etc.)?your best option is sticking to plain coffee or tea. Assuming you?re serious about coffee and tea, why water it down and cover up the taste with sugar?

By the way, if you?re watching your calories, always be prepared to refuse samples of new food and drink items offered. If not, you may consume a lot more calories than you intended. I know from firsthand experience, it?s easy to drink or eat something on impulse, and most people don?t give it much thought. Or, if you really want to try a sample, and have already satiated your sweet tooth (or calorie limit), you may want to just turn around and head out the door.

I?ll be discussing Starbucks??Favorite Food Menu in a separate post. I was pleased to learn from its interactive nutrition guide the menu included any vegan-friendly items, including the aforementioned oatmeal (140-340 calories, minus sugar) and fruit salad (80 calories). I?d recommend you stick with one of these, or a piece of fresh fruit (banana or apple), where available. I do have to question the company?s claim that it has a lot of ?smart choices? and it?s possible to ?eat sensibly? just because some foods contain under 350 calories.

On the bright side, Starbucks? recent acquisition of ?Evolution Fresh (cold-pressed juice) is an encouraging sign the chain is taking the healthy high road. Won?t you join me by requesting the company serve more nutritious whole plant-based and organic foods and drinks, too?

Church of Pentecost baptises 55 prisoners

Some 55 male Christian inmates have been baptized at the James Camp Prisons in the Nyaho area.

Reverend Derek Mereku of the Church of Pentecost-La branch performed the baptism for 45 inmates of the church while other denominations also took the opportunity to baptize their members.

The remaining denominations included the Methodist Church of Ghana, Presbyterian Church of Ghana, Seventh Day Adventist, and Global Evangelical Ministry.

This was after the Church Of Pentecost commissioned a GH?4500 baptistery for the inmates.

The church also provided food items, detergents and used clothing valued GH?1500 to them.

Giving a sermon to prepare the converts for baptism, reverend Derek Mereku urged the inmates not to see prison as a curse.

He said the camp is to be seen as a transformational centre that would change them from their old ways.

?Some of you are here by your own deeds while others were innocent but could not defend yourselves. If you did nothing wrong but you were wrongfully sentenced, do not be disturbed,? he urged the inmates.

Using Joseph in the bible as an example, Reverend Mereku said Jesus Christ knows their worries and would deliver them.

He said no one can see God unless they have a repented heart.

?You are here to be reformed, stay focused and God will accept you,? he observed.

Adding her voice the Deputy Director of Prisons (DDP) in charge of James Camp, Josephine Fredua-Agyemang said the baptism is a first for the camp.

She expressed joy that at least the inmates have received salvation.

?Those here are safe and sound. Some have changed from their old ways and have been reformed.?

She averred that the camp also gives vocational training to the inmates to equip them for the future.

Some of the vocations include carpentry, block molding, farming, piggery and rabbit rearing.

She noted that the only challenge is how to equip the carpentry shop with tools and get funds to purchase the materials for work.

DDP Fredua-Agyemang said their sick bay also needs enough drugs to serve the 354 inmates serving various sentences at the camp.

She urged individuals to help build an Information Telecommunication Technology Centre (ICT) and a library there since most of the inmates like reading.
