Judge denies motion to freeze meningitis pharmacy owners' assets

BOSTON (Reuters) - A federal judge on Wednesday denied a motion to freeze the assets of the owners of the compounding pharmacy at the heart of the deadly U.S. meningitis outbreak, but said the company may not make extraordinary cash transfers or pay dividends or bonuses to the pharmacy's owners.

Judge Dennis Saylor, of U.S. District Court in Boston, ordered an attachment of $5 million for each of the two plaintiffs who had moved for a preliminary injunction and prejudgment attachment restraining the assets of the Framingham, Massachusetts-based New England Compounding Center.

An attachment represents a preliminary seizure of property pending a final judgment in a case.

The plaintiffs, Michele Erkan and Robert Cole, who have filed a lawsuit against NECC, had also sought to freeze the assets of NECC-affiliated companies Medical Sales Management Inc and Ameridose LLC and six individual directors, shareholders and employees, up to $461 million.

These included Barry Cadden, NECC's co-owner and chief pharmacist; his brother-in-law Gregory Conigliaro, who is also an NECC co-owner; and other members of the Conigliaro family who are principals of the companies.

On Tuesday lawyers for NECC's owners argued before Saylor that there is no evidence any of them directly participated in the events that led up to the meningitis outbreak. They argued to block the motion by the meningitis victims to freeze assets of NECC and its owners.

According to the Centers for Disease Control and Prevention, 490 people have been injured by a tainted steroid distributed by NECC and 34 have died.

How To Improve Your Mental Game Of Golf | recreation and sports

To say that golf is a sport played in the head would be something of an understatement. There are few other sports which rely so much on the psychological skills of the player almost as much as the physical. Improving your mental game of golf is vital to making you a better all-round golfer.

One of the easiest ways to improve is to read more about the sport. There is a vast treasure trove of golfing literature out there, from books about great events, books on strategy and biographies of golfing greats. Explore this library as much as you can; reading and thinking about the game from as many different perspectives as you can will improve your game immensely.

Other great mental golf tips come from paying attention to what the top professionals say and do. Many top players go through some kind of psychological crisis in their careers, which often requires quite drastic psychological work; others merely need to tweak how they play on occasion. Listening to and reading interviews with players will often give you great insight into how they resolved any issues, offering you some good guidance for your own golfing career.

It also pays to read widely about matters away from the sport itself, whether that be about strategy, psychology or, indeed, other sports. Sharpening up how you think ahead and how you should consider certain situations is useful, while you can also find other perspectives which might prove useful in the long term when it comes to the psychology of golf. One text particularly worth studying is 'The Art of War' by Chinese philosopher Sun Tzu.

Another good way of improving the psychological aspects of how you approach the sport is to watch as much of it as you can. Keeping a close eye on how the world's top players approach certain situations, and the routines they use to achieve the right mindset, can be very informative indeed. Look in particular at how players pick themselves up when facing adversity in match situations.

Talking about the sport with other players, especially those who have more experience than you, can also be very useful. Other players may have psychological insights and perspectives to offer which you might not have considered before. The more thoughtful discussion you can have, the better, and you should always be prepared to listen to others who might have something to offer.

These tips should help you to improve your mental game of golf. This improvement, in turn, should lead to some positive developments when it comes to your all-round ability to play the sport well. Read, think, discuss, practice and think some more, and you will soon see dramatic improvement.

Israel, Gaza militants agree to ceasefire, Hamas official says

LOS ANGELES (Reuters) - Like the 10 winners before him, Phillip Phillips faces the uneven road from "American Idol" victor to pop-chart mainstay. After the success of his Top 10 hit, "Home," the Georgia native is facing a new challenge - to replicate the mainstream successes of past "Idol" winners Carrie Underwood and Kelly Clarkson on his debut album, "The World from the Side of the Moon," released on Monday by Interscope Records. ...

Republic Nashville?s Martina McBride, performed to a sold out Hard Rock Cafe Nashville crowd on Fri., Nov. 16 with all proceeds directly benefitting Musicians On Call (MOC) Nashville. The non-profit brings music to the bedsides of patients in six area healthcare facilities. Breaking MOC Nashville fundraising records for a single event, the benefit amassed over $35,000 all of which will be used to support the MOC Nashville branch and help to continue and expand its Bedside Performance Programs. The funds were raised from ticket sales, a silent auction, and a unique online auction that afforded one lucky winner the opportunity to join McBride on stage for a song to which winning bidder, Lyndsi Riley, chose ?This One?s for the Girls.?

?We?could not imagine a better way to celebrate our fifth anniversary in Nashville.?It was a once-in-a-lifetime opportunity to see such an icon perform in an intimate setting,??shared Katy Epley,?MOC Nashville?s Program Director.??Martina and her entire team could not have been more gracious or supportive of our efforts to bring the healing power of music to the bedsides of patients.?

McBride, who also sang her current hit ?I?m Gonna Love Your Through It,? said, ?I was so happy to be a part of the fifth anniversary of Musicians On Call in Nashville. We put together an eclectic set list of hits mixed with some of our favorite album cuts for a show that was one-of-a-kind. Mississippi Country Music Trail honors Chris Ledoux - Mississippi Link

From The Mississippi Link Newswire

JACKSON ? Country music star Chris Ledoux was recently honored with a marker on the Mississippi Country Music Trail. The marker unveiling took place at the at the Biloxi Town Green at 710 Beach Blvd., in Biloxi.

Chris Ledoux

Born on Oct. 2, 1948, in Biloxi, Chris Lee LeDoux was the son of an Air Force major stationed at Keesler Air Force Base. Young Chris lived in Biloxi for the first year and a half of his life and for another year at the age of 12, which yielded the boyhood memories of fishing holes and black-eyed peas reflected in his song, ?Born in Mississippi.?

The military family moved frequently, including a period in Texas.

Having learned to ride horses on his grandparents? Michigan farm, LeDoux focused on competitive rodeo riding as a career by the age of fourteen, and began playing guitar and writing songs as a sideline while in high school in Cheyenne, Wyoming. He was developing his talent as a sculptor in college in Wyoming and New Mexico when he left school to compete riding bareback full-time. He would compete in some 80 rodeos a year, and go on to become the world championship of bareback bronc riding in 1976.

In 1972, in part as a way to cover rodeo entry expenses, LeDoux formed the independent country music record label American Cowboy Songs with his dad Al, who was now retired, and relocated to Mt. Juliet, Tennessee, near Nashville. Al and Chris?s mother Bonnie effectively ran the record company, shipping out to his rodeo fans the tapes of songs he wrote and recorded, songs that reflected the rodeo cowboy life, and promoting him as ?The Singin? Bronc Rider.? Chris married Peggy Rhoads of Kaycee, Wyoming, that same year; they would raise five children at their Kaycee home base. While competing in rodeo, LeDoux would sell some four million dollars? worth of 22 albums that he described as encompassing ?Western soul, sagebrush blues, cowboy folk and rodeo rock ?n? roll,? enough so that when he retired from the rodeo circuit in 1980, he was able to re-focus on performing his music, his energetic, bold live shows making him a Western cult figure.

In 1989, he came to national attention when emerging country megastar Garth Brooks referred to playing a ?beat-up Chris LeDoux record? in his hit ?Much Too Young (To Feel This Damn Old).? He then signed with a record company, the Liberty label at Capitol Records, and had a Top Ten National Hit, in 1992, a Grammy-nominated duet with Brooks, ?Whatcha Gonna Do With a Cowboy.? Chris LeDoux can be credited with reviving the Western end of what had been ?Country & Western? and setting the stage for more explosive, visual country arena shows in the musical career that spanned the rest of his life, which was shortened by liver disease. LeDoux died in March 2005, and was inducted into the ProRodeo Hall of Fame and awarded the Academy of Country Music?s Pioneer Award posthumously later that year.

I like purchasing from the counters rather than online websites as almost all the brand SAs know me and I get lots of gifts on single purchases also. • Shade:The shade no.53 light beige is kind of a neutral shade having beige undertones. The shade that was on tone darker than this was looking ashy on my skin and this one seemed to be brighter so I took this shade.

  • Packaging:The packaging is unique with a glass bottle with a pump dispenser having a sponge applicator on top. The sponge is soft but I haven?t ever used it as I want my product to be clean. I always used square sponges or a stippling brush for foundation application. However, the packaging is not travel friendly as the bottle doesn?t close securely so there are chances of it falling and breaking.

BOURJOIS FLOWER PERFECTION FOUNDATION 53(LIGHT BEIGE) SWATCHES & REVIEW+Bourjois Flower Foundation Blended

?

Texture, finish & staying power:The texture is smooth, non-shimmery. The coverage is medium in a single coat which can be build up to a heavy coverage if needed. It hides minor skin flaws, redness in single layer. The finish is very matte and a good moisturiser is needed for proper blending otherwise it looks patchy on skin.It feels very light on skin and has a pleasant flowery fragrance. I feel that this foundation sometimes accentuates dry areas of my skin as I have a combination skin.Staying power is great upto 8-9 hours. It doesn?t smudge or transfer to other objects.
